PRIVACY POLICY

 

This Privacy Policy (the “Policy”) explains how AME Learning Inc. (“AME”) collects and uses the personal information that you provide to AME. Your use of the www.ameengage.com and www.amelearning.com websites (the “Website(s)”) shall be governed by this Policy. If you do not agree to be bound by this Policy or do not want to provide AME with your personal information, do not use the Websites. AME reserves the right to make changes to this Policy at any time. If you do not agree with any such changes, your only remedy shall be to stop using the Websites. Your continued use of the Websites constitutes your acceptance of such changes.

INFORMATION COLLECTION AND USE

You acknowledge and agree that by accessing the Websites you voluntarily consent to the collection, use, retention, and disclosure of personal information in accordance with this Policy. You acknowledge and agree that AME requires certain personal information to provide you with the Websites.

 Personal Information

 ·        Personal information means any information relating to an identified or identifiable individual. The types of personal information that AME processes are determined by how individuals interact with AME and the particular products and services that AME provides. The types of personal information that AME processes include:

·        Identifiers, such as name, email address, username, IP address;

·        Contact information, such as email address, postal address, and telephone number;

·        Commercial information such as purchase history; or

·        If you make an online purchase from us, in addition to your name, we collect payment information through a third-party payment processor, which includes billing and shipping addresses and credit card number to process your transaction.

We may also collect information regarding how the Websites are accessed and used. This usage data may include information such as your computer’s IP address, browser type, browser version, the pages of AME Websites that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

Tracking & Cookies

We use cookies and similar tracking technologies to track the activity on AME Websites and hold certain information. Cookies are files with small amounts of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are scripts to collect and track information and to improve and analyze AME Websites. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of AME Websites.

AME Obligations 

AME is committed to protecting the personal information of its Website users. AME shall (a) collect, use, and disclose your personal information following this Policy, and (b) not sell or rent any personal information to any third-party.

 You agree that AME may disclose your personal information in the circumstances set out below:

 ·                 To your institution as required for the provision of the AME Websites or administrative purposes, including without limitation compiling a list of student users or institution users who use the Websites;

·                 If you are a student user, AME may disclose directory information to your institution and third-party website providers as required for the provision of the Websites;

·                 With third-party website providers to provide services to AME;

·                 With third-party payment processors;

·                 To third parties in connection with a corporate reorganization, merger or amalgamation, or the sale of all or substantially all its assets, provided that, where appropriate, any party to whom the information is disclosed is bound by agreements or obligations, and required to use or disclose your personal information in a manner consistent with the use and disclosure provisions of this Policy; or

·                 AME may be required or permitted by law to disclose personal information without your consent in the event AME has reasonable belief that there may be harm to you or another person, in emergencies, or when required by law, government, valid legal process, or other legal authority.

User Rights

 The rights provided by data privacy laws vary by geographical location, and typically include your right to ask for:

 ·                  Access to the personal information AME has about you;

·                  An electronic copy of the personal information AME has about you;

·                  Correction of any errors in your personal information;

·                  Deletion of your personal information.

 If you have given your consent to processing, you can withdraw that consent at any time. If you wish to review or change your marketing preferences, you can use the “opt-out” or unsubscribe mechanism provided within the communications that you receive from us. You may still receive necessary transactional communications if you engage with AME products or services.

Access and Correction

You are entitled to access and correct your personal information at any time. AME will, at your request by email at support@amelearning.com, provide you with copies of your personal information AME has in its possession, including for the purpose of correcting or updating your personal information. Before AME provides you with access to your personal information, AME will require proof of identity. For most requests, your personal information will be provided free of charge; provided, however, AME may charge a reasonable fee if such request requires a substantial effort on AME’s part. If AME refuses to provide you with access to your personal information, AME will provide you with reasons for the refusal.

Use of Personal Information

AME uses personal information where it is necessary to perform contractual obligations, where consent has been given, where it is necessary to comply with a legal or regulatory obligation, or where AME or a third-party have a legitimate and lawful business need. This includes processing personal information for the following purposes:

Performing contracts or other transactions that AME enters into;

Providing, managing and supporting AME Websites, products and services;

Providing customer support and monitoring Website usage.

·                  Marketing and communication

Communicating about AME programs or events;

Marketing AME Websites, products, or services;

Responding to enquiries, requests, or other communications.

·                  Development

Evaluating and improving AME business and Websites;

Performing data analytics for internal research;

Personalizing AME Websites, services and products.

Detecting and investigating fraud and suspicious activity and keeping Websites safe and secure;

Detecting, preventing and addressing technical issues.

We may use personal information for other purposes that AME informs you of where AME has prior consent, a legitimate business interest, or another lawful basis to do so.

We may aggregate or anonymize information so that it is de-identified and can no longer be used to identify individuals. This information may be used for analytical purposes such as developing AME products and services.

 

Disclosure of Personal Information

AME will not sell your personal information to a third-party, and AME will only share your information when it is necessary to help facilitate the effective operation of AME’s business and services. Examples of how AME may share the information we collect from you include:

 ·                  With companies that provide AME with business services including those that process credit card and debit card transactions. These service providers will be given only the information that is necessary to allow them to effectively deliver services;

·                  Through integrations, AME has with software systems provided by businesses and educational institutions where learning and assessment-related data such as your engagement level, scores you obtain on assignments and tests, and other learning analytics are transferred between systems;

·                  In aggregated, anonymized, or de-identified form which cannot reasonably be used to identify you;

·                  In response to a request for information from a competent authority if AME believes disclosure is otherwise required by applicable law; and

·                  With law enforcement officials, government authorities, or other agencies as necessary to comply with legal process; protect the rights, property, or safety of AME, its business partners, you, or others; or as otherwise required by applicable law.  

Before AME shares personal information with any service provider, they must agree to comply with applicable laws, maintain strong data security, and only process personal information as AME instructs. We may also share personal information in connection with corporate transactions, such as a transfer of assets, merger, acquisition, consolidation, or change of control.

Security Measures

AME employs reasonable administrative, physical, and technical measures to ensure that your personal information is secure. Unfortunately, no security system can be guaranteed to be totally secure. The Internet is not a secure medium and you acknowledge and agree that the privacy of your e-mail communication and personal information can never be guaranteed as any e-mail communication may be lost, intercepted, or altered. Third-party service providers are bound by agreement or obligations with AME to implement and maintain reasonable security procedures and practices to use and disclose your personal information in a manner consistent with the use and disclosure provisions of this Policy unless you consent otherwise.

AME takes all reasonable measures and precautions to protect your personal information when it is being handled by third-party service providers. Access to your personal information is restricted to only those who need to know that information to perform their jobs. AME ensures its employees and contractors understand the importance of maintaining the confidentiality and security of your information. Despite these efforts, AME cannot guarantee that unauthorized access or disclosure of information will never happen. If you have concerns, then please do not use the Websites. 

Retention of Personal Information

We keep personal information for as long as necessary to carry out the purposes described herein, to resolve disputes, and for any additional period required by law.

Access to Information

We support individuals’ right of access to, and the right to request correction of, personal information about themselves. We will provide access to information upon request by email to support@amelearning.com.

Third-Party Service Providers

We may employ third-party companies, payment processors and individuals to facilitate the Websites, to provide the Websites on AME’s behalf, to perform Website-related services or to assist AME in analyzing how AME Websites are used. These third parties have access to your personal information only to perform these tasks on AME’s behalf and are obligated not to disclose or use it for any other purpose.

Some third-party integrations such as those AME has with learning management systems will allow you to register and sign in through the third-party system without the need to login to AME Websites. If you are using one of these integrations, then any personal information collected during that third-party registration and login is subject to the information security and privacy policies of the third-party. 

Links to Third-Party Websites

Our Websites may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third-party’s website. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party websites or services.

Privacy of Minors

We do not knowingly collect, use, or disclose information from or about a child under 14 years old without the prior consent of their parent or guardian. If you are a minor under applicable law, you should not use AME’s Websites or services for any purpose without first obtaining consent from your parent or guardian. If you would like to review any personal information that AME have collected from your child, or to request the deletion of such information, or to request that there be no further collection or use of your child’s information, or if you have questions about these information practices, please contact AME.

Our commitment to privacy extends to the protection of minors under 18 and adherence to the Ontario Education Act (and similar provincial legislation throughout Canada) and the Family Educational Rights and Privacy Act in the United States, which govern the privacy of student education records and restrict the disclosure of personal information from a student user’s education records. We ensure that AME data protection and privacy practices allow educational institutions to comply with this legislation, alongside other applicable laws. Students and their guardians have rights to access, update, or correct their personal information. We maintain rigorous procedures to verify identity and secure permission before any data amendment, upholding AME dedication to privacy and legal compliance.

Changes to Privacy Policy

We may update this Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We will let you know via email or a prominent notice on the Websites, prior to the change becoming effective. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted.
